Alabama Death Row inmate set to die in July for 1994 slaying of ex-girlfriend
An inmate on Alabama’s Death Row is set to die by lethal injection next month.
Joe Nathan James, Jr., 49, is set to be executed on July 28 at William C. Holman Correctional Facility in Atmore. The execution date comes more than 24 years after he was first sentenced.
James was convicted of capital murder twice for the shooting death of Faith Hall in Birmingham. Hall was James’ former girlfriend and was killed on Aug. 15, 1994.
Court records show James was first convicted on the murder charge, made capital because it was committed in the course of a burglary, in August 1996 and sentenced to death row. Two years later, a court overturned his conviction and sentence due to hearsay being admitted into evidence.
In 1999, James was again convicted of capital murder and sentenced to death.
In filings to the Alabama Supreme Court in 2009, a lower court’s ruling said Hall “had been stalking and threatening Ms. Hall before her death.” On the night of her death, James followed Hall and a friend to the friend’s apartment before forcing his way into the apartment and shooting Hall multiple times.
According to a federal court ruling, James and Hall dated in the early 1990s and had a “volatile” relationship. Court records said, “James stalked and harassed (Hall) after they broke up, showing up uninvited at her home on several occasions and threatening to kill (Hall) and her ex-husband.”
On the day of the shooting, records show James followed Hall and her friend to the friend’s apartment and forced his way inside. Once inside, he “demanded to know about a man he had seen” with Hall, and then shot her as she ran. Hall was shot three times: Once in the abdomen, once through the arm and chest, and once in the top of the head, records state, after she had fallen to the floor.
After several appeals, the Alabama Court of Criminal Appeals upheld James’ conviction in 2010. The Alabama Supreme Court declined to review James’ case in 2017. James appealed to the federal appeals court, arguing his lawyers were ineffective during the sentencing phase of his second trial because they failed to investigate or present evidence on his behalf.
In April 2020, the U.S. 11th Circuit Court of Appeals upheld James’ conviction. The court’s published opinion said James “failed to show a reasonable probability that his counsel’s performance affected the outcome of his sentencing proceeding.”
The Alabama Attorney Generals Office asked the state Supreme Court to set an execution date for James in July 2022
